Terms of Use

These terms govern your use of ESDvalidator: the website, the free diagnostic, the API and the dashboard (together, the "Service"), operated by ESDvalidator ("we", "us"). By creating an account or using the Service on behalf of a company, you agree to these terms for that company and confirm you are authorized to do so.

In short: You keep your data, every saving we show is an estimate, and you never send us card numbers.

1. What the Service does

The Service helps businesses that accept commercial cards in the United States reduce the interchange they pay. The diagnostic reads the fee reports you download from Adyen or Stripe and estimates how much interchange you could have saved. The API checks and corrects Level 2 and Level 3 transaction data before you send it to your gateway. The dashboard shows what happened in your requests.

The Service works on top of your existing payment processor. We do not process payments, hold funds or act as your acquirer, gateway or payment facilitator. We correct format and consistency in the data you send, and we never fill in values that are not in your data.

2. Estimates, not guarantees

Every saving, cost and rate shown by the Service is an estimate based on published or illustrative rate tables, or on the rates you enter. Interchange rates and Level 2 or Level 3 qualification are decided by the card networks, issuers and your acquirer. We do not guarantee that any transaction will qualify for a given rate or program, or that you will achieve any particular saving.

3. Your account

  • Keep your password, two-factor device and API keys secure. You are responsible for activity under your account and keys.
  • Tell us promptly at hi@esdvalidator.com if you believe your account or a key has been compromised, and revoke the key in the dashboard.
  • Organization owners and admins control who has access to the organization's data.

4. Acceptable use

You agree not to:

  • send full card numbers, card security codes or other sensitive authentication data to the Service. We reject them, but you remain responsible for not sending them;
  • upload data you have no right to share, or use the Service for unlawful purposes;
  • exceed rate limits, probe or disrupt the Service, or access another organization's data;
  • resell the Service or use it to build a competing product without our written consent.

5. Your data

You keep all rights to the data you send. You give us permission to process it only to provide, secure and improve the Service, as described in the Privacy Policy and the Data Processing Agreement, which form part of these terms. You are responsible for the data you send to your gateway, including any correction you accept from the Service.

6. Fees

The Free plan is not charged and has the limits shown on our pricing page. Paid plans are charged monthly, in advance, through Stripe, at the prices shown on the pricing page when you subscribe.

Each paid plan includes a number of units a month. Units used past that number are charged in arrears, at the end of the billing cycle, per block of 1,000 units started, at the overage price shown on the pricing page when the units are used. An owner of your organization can turn on a cap at 150% of the included units on the Billing page; with the cap on, calls past it are refused until the next month starts (UTC), and no overage is charged past the cap.

You can cancel a paid plan at any time from the Billing page in the dashboard. Your plan stays active until the end of the period you have already paid for.

7. Availability

We work to keep the Service available, but it is provided without a service level commitment. Design your integration so that a payment is sent to your gateway even if the API does not answer in time.

8. Third-party marks

Visa, Mastercard, American Express, Adyen and Stripe are trademarks of their respective owners. We are not affiliated with, certified by or endorsed by any of them.

9. Suspension and termination

You can stop using the Service and ask us to delete your account at any time. We may suspend or terminate access if you breach these terms or if your use puts the Service or other customers at risk. On termination, your data is deleted as described in the Privacy Policy.

10. Disclaimers

Except as expressly stated in these terms, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or interchange savings. Our total liability for any claim relating to the Service is limited to the fees you paid us under these Terms in the 12 months before the event giving rise to the claim.

12. Changes to these terms

We may update these terms. We will post the new version here and, for material changes, notify account owners by email at least 30 days before they take effect. Continuing to use the Service after that means you accept the new terms.
